The Legislative Acts Which Constitute the Sources of EU Banking Law

Abstract

This chapter overviews the legislative acts which constitute the sources of EU banking law, by systematically presenting their general aspects, their objective and field of application, and the system of their rules. These legislative acts are the Council’s Regulation establishing the Single Supervision Mechanism (SSMR) and the co-legislators’ Regulation establishing the Single Regulation Mechanism (SSMR) (i.e., the key pillars of the Banking Union (BU); the Capital Requirements Regulation and Directive (CRR and CRD IV, respectively), which contain the key rules of the single rulebook on the prudential regulation and supervision of credit institutions; the Bank Recovery and Resolution Directive (BRRD), which contains the key rules of the single rulebook on the resolution of credit institutions (and investment firms); the Deposit Guarantee Schemes Directive (DGSD); and the Directive on the reorganisation and winding-up of credit institutions. The chapter concludes with an Excursus on the Emergency Liquidity Assistance (ELA) mechanism.
