Abstract

Zusammenfassung Die EU hat zwei Möglichkeiten, das Problem der gemischten Migration zu lösen: Erstens sollte sie den Geltungsbereich der Flüchtlingskonvention von 1951 ausweiten und ihn besser an die heutigen Realitäten der erzwungenen Migration anpassen. Außerdem sollte die große Vielfalt der bestehenden vereinzelten Regelungen für den vorübergehenden humanitären Schutz harmonisiert und kodifiziert werden. Zweitens sollte die Verflechtung zwischen den verschiedenen Arten/Kanälen der Migration anerkannt und ein umfassender Ansatz verfolgt werden. Die EU sollte ein neues Modell der Partnerschaft mit den Herkunftsländern einführen, das darauf abzielt, eine geordnete und sichere Migration/Asylsuche auf der Grundlage eines dauerhaften gegenseitigen Interesses zu gewährleisten. In der EU erklärt die strukturelle Diskrepanz zwischen dem kollektiven Engagement der Mitgliedstaaten auf Gemeinschaftsebene und ihrem eifrigen Festhalten an der nationalen Souveränität die wechselhaften Entscheidungen und das schwindende Vertrauen der Öffentlichkeit in die Flüchtlingspolitik der EU. Die Vertreibung von Menschen sollte bei der strategischen Vorausplanung aller rechtmäßigen militärischen Interventionen vollständig berücksichtigt werden.
