Mapping Contradictions Within the Legal Frameworks and Cultural Norms on women’s Right to Land and Agriculture in Western Kenya

Abstract

We argue that for any meaningful agricultural outcomes to be achieved, women’s land rights need to be guaranteed. This study endeavors to outline why despite Kenya having in place progressing legislative frameworks, women still lag behind in terms of secure land rights. We lay out the contradictions between legal frameworks and cultural norms, even as the latter seeks to maintain the status quo that denies women their rights. The study adopted feminism as the basis for designing the methodology and as an analytical framework. The study used a sample of 184 people and data was collected through focus groups and key informant interviews. We acknowledge the importance of cultural norms but also make a case for the need to expedite the implementation of legislative frameworks, where women’s rights continue to be disregarded on the basis of cultural expectations.
