Agricultural Land Conversion and Land Rights in Vietnam: A Case Study of Farmers’ Resistance in the Peri-Urban Areas of Hanoi

Abstract

The overall aim of the paper is to examine the nexus between farmers’ resistance (including their justification and strategies) to agricultural land conversion and their claim of rights without changing the system. In terms of methodology, data were collected both from primary and secondary sources. On the primary source, data were collected via key informant interviews and in-depth interviews, which combine different levels. Some key findings of the paper are (1) the current land law does not guarantee farmers’ land rights. (2) Farmers’ strategies are varied and combine both formal, that is, legal actions and informal actions (beyond the scope of the law) to influence public opinion as well as the political and legal decisions taken by the Party and the State. (3) The claim for land rights goes beyond economic social and cultural rights and civil and political rights to address the inadequacies in land management and state power in land clearance for commercial development projects.
