Abstract

The projected earnings that the Plaintiff would have earned had their employment not been terminated by the Defendant is frequently referred to as the Plaintiff’s ‘but-for’ employment termination earnings. The projection of earnings that the Plaintiff would have made at the Defendant employer but-for the alleged discrimination is made by examining company specific factors such as the Plaintiff’s earnings history at the company, position at the company, education level and other factors related to the Plaintiffs position at the Defendant. Defendant company specific data on issues such as job advancement opportunities, expected job tenure and retirement are also typically utilized in determining the Plaintiff’s but-for employment earnings potential at the Defendant employer. This section discusses these issues.
