Abstract

In this case study, we provide an example of a Plaintiff in an employment terminationEmployment termination lawsuit who was employed as the Chief Financial Officer of a well-known firm in the financial sector. Due to her termination, the Plaintiff alleges that she incurred economic damagesEconomic damage which included not only her base salary and incentive compensation, but also compensation under a phantom stock program. As will be discussed, there are numerous components of an executive’s economic damageEconomic damage calculation that must be appropriately taken into account, such as not only the availability of executive-level jobs in the Plaintiff’s labor marketLabor market, but also the underlying elements of the employer phantom stock program and other forms of incentive compensation.
