The Ghana-Côte D’Ivoire Maritime Boundary Dispute: A View from the Ghana Side

Abstract

On 22 September 2014, Ghana served Côte d’Ivoire a notice under the hand of its Attorney-General dated September 19, 2014, instituting proceedings to have the maritime boundary between the two countries delimited, pursuant to the mandatory dispute resolution provisions of the UN Law of the Sea Convention (UNCLOS). Then on 23 September 2017, three years after the institution of proceedings, a Special Chamber of the International Tribunal of the Law of the Sea (ITLOS), gave judgment delimiting that boundary and pronouncing on a number of related issues. The judgment, in essence, upheld the boundary line that Ghana claimed and rejected the radically different Ivorian claim. However, the Tribunal rejected several bases for Ghana’s claims and expressed some reservations about Ghana’s conduct in continuing to authorize petroleum operations once it became clear that there was a dispute between the parties. This chapter seeks to give, from the viewpoint of a member of the Ghana team, an account of the proceedings and their antecedents, as well as some of their ramifications for petroleum operations in the country.
