Setting up a National Petroleum Regulator: The Petroleum Commission and Management of Ghana’s Petroleum Resources

Abstract

The Petroleum Commission was created by the Petroleum Commission Act, 2011 (Act 821), and assumed responsibility as Ghana’s upstream petroleum sector regulator. The Commission also derives its legal mandate from Article 269(1) of the 1992 Constitution of the Republic of Ghana. Before 2011, the Ghana National Petroleum Commission (GNPC) regulated the industry on behalf of the Minister for Energy. This chapter charts the evolution of the Petroleum Commission as an upstream regulator. It discusses the steps the Commission has taken since its establishment to become the competent authority, regulating and managing Ghana’s petroleum resources. The chapter also critically analyses the performance of the Commission’s three core duties: regulatory, advisory and technocratic functions. Furthermore, the chapter assesses what steps the Commission has taken to build its technical and financial capacity over the past ten years.
