Should We Abandon the Concept of Artistic Craftsmanship in the Copyright Act in Australia?

Abstract

In many buildings, such as hotels, shopping malls, it is to common find some statutes and other artistic work. The absence of a definition for a work of artistic craftsmanship creates significant problems in Australia’s legal sector. Some people even believe that it would be better to abandon artistic craftsmanship in the Copyright Act. This chapter begins with a review of artistic craftsmanship in the Copyright Act, followed by a study of the possibility of replacing this protection with other legal rules and regulations. This study concludes that the inclusion of artistic craftsmanship contains some value in Australia in spite of the inherent problems.
