USA Versus EU Competition

Abstract

Antitrust laws in the USA, and competition rules in the EU, are set out in statutes of general applicability, written in broad, almost constitutional form. EU and US antitrust policies differ in a number of vital matters. Article 102 TFEU more closely aligns with the original, pre-Chicago School understanding of Section 2 of the Sherman Act. While the US centers on protecting the process of competition for the economic welfare of consumers, the EU upholds its competition laws to affect a wider range of political/economic/social objectives. Additionally, the US and European antitrust regimes diverge considerably with regard to the objectives they engage in.
