Abstract

This chapter ascertains the implications of the maritime legal regime with a focus on India’s ratification of the Rotterdam Rules. It examines the maritime legal regimes of different countries that are already signatories to the Rotterdam Rules and the attempt to apply a similar reasoning in the Indian context. It addresses the issues of liabilities and responsibilities and explains the roles of the customs. The chapter also examines the responsibilities of different stakeholders under the current legal regime and introduces the Rotterdam Rules. Finally, it defines the performing party and the maritime performing party and discusses the implications of dry port as a performing party.
