The Integrated Lawyer (2): Translating Law into Practice

Abstract

Previous chapters have given some indication of the legal areas and issues that confront company lawyers, and the prevailing emphasis amongst in-house lawyers on ‘proactive law’, which I have preferred to refer to in broader terms as ‘integrated’ lawyering. The last chapter dwelt on the preventive aspects of in-house legal work, ranging from the lobbying activities of inhouse lawyers to their more immediate and central work of preventive law through environmental scanning, both internal and external. The skilled lawyer, however, is more than an information-gatherer scanning the internal and external legal environment. How do in-house lawyers translate legal information into client behaviour and decision-making? How do they influence the day-to-day actions of the business? We have already touched on aspects of this in the previous chapter, but this chapter focuses more directly on the applied skills of lawyering, on the lawyer’s role in guiding client actions, on the lawyer’s effectiveness.
