Abstract

As stressed in the last chapter the author of this book is not a lawyer. The descriptions of law and practice in various countries which follow are general rather than legal descriptions of: the institutions and stages of pre-insolvency provided for under the law; the way in which these institutions work in practice rather than in legal theory (and the two are sometimes similar but more often different); some comments on whether law and practice tend to favour the creditors, the debtors or the management; a comment on the degree of professionalism or otherwise of the insolvency practitioners in the country concerned; some comment on the extent to which the courts take a commercial or legalistic point of view; and finally a brief indication of any points which differ significantly or carry particular dangers for bank lenders.
