The ‘Institutional Lease’

Abstract

The ‘institutional lease’ is possibly the most important legal document used by the property funds of investing institutions. It is the legal contract which grants a tenant the right to occupy the investor’s property and as such it is at the very heart of the investment; it legally links the investor’s capital asset with his legal rights to enjoy a stream of rental income from that asset. The growth and development of this document is considered in an historical context in Chapter 2. The purpose of the present chapter is to give an outline of the more important clauses with reference to some statutes and case law.
