Personal Consumption and Wrongful Death Damages

Abstract

The personal consumption of the decedent is the key separator between the forensic economic determination of personal injury and wrongful death economic damages. This chapter presents personal consumption as an empirically challenging and controversial topic. Because the traditional personal consumption methods are largely ad hoc to a normative goal, this chapter suggests that the topic is due for a re-examination; a good place to start might be with the consumption decisions that are forced upon survivors due to wrongful death.
