Abstract

Chapter 6 describes the trade remedies regimes and the reasoning behind them. It begins by discussing the World Trade Organization (WTO) disciplines on anti-dumping duties (ADDs) and countervailing duties (CVDs). It then discusses the U.S. procedure for initiating, conducting, and concluding ADD and CVD investigations through the International Trade Commission (ITC) and Department of Commerce. After describing the appeals process, it explains each substantive requirement for an affirmative determination of both dumping and countervailable subsidies. It then discusses another form of trade remedy, the safeguard measure ("emergency action on imports'). After outlining the WTO disciplines regulating the use of safeguard measures, it walks through the procedure for applying to the U.S. ITC for safeguard measures, the remedies available, and the review process. It concludes with a discussion of Section 301 of the Trade Act of 1974 as a method of pressuring the U.S. Trade Representative to protect domestic industries.
