Abstract

Chapter 5 discusses U.S. import and export regulation. After a brief history of customs law, it explains the importation process. It identifies the sources of customs law and regulation, and walks through the process of entering goods through customs and calculating customs duties, including preferential and non-preferential rates of duty and rules of origin. It then explores methods of duty minimization and avoidance through such means as bonded warehouses, foreign trade zones, and drawback. It also covers marking rules and enforcement procedures. It then turns to export regulation and explains the history and treaty regimes that structure U.S. cooperation with its allies in the exportation of arms, munitions, and "dual-use" items having both civilian and military uses. It describes the systems of regulation: Foreign Trade Statistics Regulations, Export Administration Regulations, International Traffic in Arms Regulations, and trade and economic sanctions regimes. Finally, it discusses the U.S. antiboycott regulatory regimes.
