Abstract

Intellectual property is premised on a social contract that states that society is willing to put up with an artificial reduction in competition in exchange for creation and knowledge about that creation. This is anthropocentric, triangulating individuals, society and intellectual property. But what about nature? This chapter examines how there could be natural contracts, the ways in which this could affect intellectual property law, including potentially allowing non-Western and Global South perspectives to undergird intellectual property, and whether this could improve access to clean water and sanitation.
