Renewable energy technology and intellectual property rights: global public goods

Abstract

The transition to carbon neutral society will require many challenges to be overcome. Energy generation from renewable sources will be one of the most significant of these. This must occur in all countries of the world, in a fair and equitable manner. Within this chapter we consider the role of intellectual property rights in supporting the transition to clean and renewable energy. Although intellectual property rights can arguably be considered a barrier to technology transfer, the literature indicates that this may not be the case. Further, it is important to recognise that invention is only one part of technology transfer, with capacity building a critical component that is often overlooked. Within this chapter we argue that if global energy security through renewable sources is the objective, then intellectual property rights will only have a very minor role to play.
