Unidroit and the struggles in harmonising succession law

Abstract

The aim of the chapter is to investigate whether a set of model rules in the field of succession law would be beneficial for the subject’s development at an international level, both as a tool for discussion within scholarship and as a source of inspiration for legislative reforms around the world. The attempt at answering this question requires identifying and describing the peculiar positioning of European succession law and highlighting some difficulties encountered by harmonisation projects on particular subjects of succession law. The subsequent section will deal with peculiarities of comparative methodology in the field of succession law. A brief discussion of three selected key areas will then be helpful in understanding if and how model rules could prove beneficial in addressing contemporary problems. Some concluding remarks will summarise advantages and drawbacks related to the establishment of model rules on succession law.
