The protection of cultural heritage in the event of disasters

Abstract

This chapter analyses the main legal, institutional and operative challenges to the protection of cultural and natural heritage in the event of disasters. The author argues that although disasters are a significant challenge for the protection of cultural and natural heritage, interest in addressing this issue through proper standard-settings and relevant initiatives has been limited for a long period. The analysis provided in this chapter might permit to appreciate how a more contextualized and evolutionary interpretation of existing treaty provisions pertaining to international cultural heritage law and the development of innovative practice tailored to address such contexts. In this regard the increasing influence and cross-fertilization between international cultural heritage law and IDL might play a fruitful role in strengthening the protection of cultural and natural heritage, but such concerns need to be more clearly integrated into instruments and initiatives pertaining to disasters.
