The right to international solidarity and the right to development

Mihir Kanade explores the multidimensional relationship between the right to development and international solidarity, including the proposed right to international solidarity. Through a historical analysis, the chapter begins with identifying the common and interdependent motivations that have underpinned their evolution. It then analyzes their symbiotic relationship through a juxtaposition of their definitions, and exploration of their common elements including their attention to collective rights, the comprehensive nature of the duties of states, the normative framework of “collective concern of humankind”, relation with the right to self-determination, the duties of non-state actors and international organizations, and the special and remedial measures entailed. Finally, the chapter analyzes how the operationalization of these norms can greatly enhance the conceptual and programmatic frameworks of human rights-based approach to development and human rights impact assessments that are dominant in praxis. The chapter concludes with observations on the significant value that the proposed right to international solidarity, in conjunction with the right to development, can add to the human rights project and thus ensure its completeness by plugging in existing gaps.
