Merger control and sustainability in the energy sector

Abstract

For several years now there has been debate on the intersection between competition law and sustainability. That debate has largely focused on the question of to what extent anti-competitive agreements may be beneficial for sustainability goals. This chapter instead focuses on the largely overlooked topic of what role merger control can and should play. The chapter explores the extent to which central notions of merger control are or are not compatible with sustainability goals. It posits that sustainability considerations can indeed have an impact on merger control analysis.
