Abstract

The regulation of the financial sector in the EU has undergone a profound change after the financial crisis of 2008. For the purposes of the EEA Agreement, the rules are mainly contained in Annex IX of the EEA Agreement. Given the cross-border nature of financial services, the general principles of EEA law, such as equality and reciprocity, as enshrined in recital 4 of the EEA Agreement, are of particular importance. A surprisingly large proportion of the case law from the EFTA Court relates to financial services. However, the incorporation of EU financial legislation into the EEA Agreement has not been straightforward. Some particular features have shown to present challenges on the technical level in the EFTA pillar of the EEA.
