Abstract

This chapter focuses on the law and economics of enforcement and dispute resolution in international trade agreements. It introduces the concept of self-enforcing agreements, and discusses the role of formal adjudication versus informal enforcement in a “repeat play” setting. Further topics include standing to bring legal claims, as such versus as applied claims, the nature of sanctions for violations and their calibration, the concept of non-violation claims, and the role of the Vienna Convention in treaty interpretation. The analysis also addresses the current impasse in the WTO Appellate Body and its genesis.
