Abstract

This chapter considers the design and structure of trade agreements regarding trade in services, with emphasis on the WTO Agreement on Trade in Services (GATS). It explains why GATS has a fundamentally different design from GATT, involving detailed negotiations and bindings pertaining to behind the border measures. It also discusses the limited jurisprudence under GATS, including questions regarding the meaning of “services” and the division of labor between GATS and other WTO treaty instruments. The chapter concludes with a discussion of ecommerce and the rise of digital trade.
