Safeguard measures

Abstract

This chapter examines the use of safeguard measures, which provide temporary trade protection to domestic industries suffering serious dislocation or threat thereof because of increased import competition. It reviews the legal requirements for safeguard measures and considers the economic arguments for and against the use of such measures. It discusses at length the WTO jurisprudence regarding safeguard measures and highlights several features that reflect economic incoherence, especially in reference to the requirements of “unforeseen developments,” Increased imports quantities, and causation.
