Financial crime: the regulators perspective

Abstract

Financial regulators often are state actors and, as such, operate within a political context and are part of a much larger government bureaucracy. They must be able to meet the challenges of addressing regulation of novel financial products and new iterations of investment scams within existing budgetary resources. Financial regulators deal with a subject matter which is unfamiliar to many thatimposes a burden of continuously educating various constituencies and stakeholders concerning financial crime and its devasting impact on its victims. To thwart the ingeniousness of fraudsters, they must continuously innovate by developing new legal structures and theories that provide for effective deterrence, recovery of investor funds and cooperation with other agencies and jurisdictions.
