Extraterritoriality in the global governance of corruption: legal and political perspectives

Abstract

This chapter reviews recent enforcement trends in the global governance of transnational bribery and corruption and theorizes these developments through the lens of extraterritoriality. The concept of extraterritoriality here provides a perspective on global governance, though which to apprehend the extent to which an ostensibly multilateral governance arrangement is in fact grounded in the domestic norms, politics, and particular interests of a dominant state. The chapter has two main goals. The first is to provide an overview of recent trends and cases in anti-corruption law, starting with US enforcement of its Foreign Corrupt Practices Act - in which extraterritoriality is a prominent feature. The second goal of the chapter is to consider the implications of these trends for the theory and practice of global governance, more generally.
