Criminal law extraterritoriality

Abstract

This chapter examines the way the United States - one of the most extraterritorially aggressive states in the world - uses extraterritorial criminal laws in practice. Providing an overview of the key issues, it digs into the practice of criminal extraterritoriality and attempts to draw lessons from those practices, describing those practices in the contexts of adjudicatory and prescriptive jurisdiction. The chapter’s primary purpose is to clarify how extraterritorial criminal laws can be categorized. The chapter also demonstrates when and how international law plays a part in assertions of extraterritorial criminal law, and how this is often complicated in the United States.
