A Chinese Communist Party perspective on development and the environment: socialism through environmental development?

Abstract

The Ministry of Justice of the Peoples Republic of China has recently published the ‘Major Principles and Priorities for Law Based Governance in China’. The formulation of these principles and priorities clarifies that the PRC’s understanding of what law is, differs significantly from other legal cultures. Its main feature is that Xi Jinping Thought on Socialism with Chinese Characteristics for the New Era is both a theoretical framework source of law and policy for the PRC. This book chapter will embark on a general overview of the Xi administration’s approach to development and the environment which it calls Ecological Civilization. Ecological Civilization is a constitutional concept, and the ministry of justice has said that it is committed to advancing legislation in key areas, Ecological Civilization is one of these areas. However, there is no specific law on the concept although it is mentioned in various national environmental laws and in policy guidelines for the Belt and Road Initiative. Currently EC lacks clear legal definitions, but this is changing. This chapter will explore the Party-state ideological perspectives and academic discussions on the concept to illustrate what challenges and innovations Ecological Civilization may offer.
