Abstract

This Chapter considers some of the key legal issues arising in the context of tokenisation with regard to smart contracts. In particular, after considering the great potential that self-executing blockchain-based contracts bring about for the evolution of world trade, it focuses on some areas that have received comparatively less attention from legal scholarship, connected with the existence of legal hurdles that might hamper the widespread adoption of smart contracts in national and international business practices. The Chapter then looks at how current regulatory trends are responding to such challenges. In the end, also in this field some final reflections are offered on the broader public-policy question of the extent to which the law needs to be changed to accommodate new technologies.
