Legal theory doctrines and economic concentration: the ebbs and flows of antitrust enforcement

Abstract

The chapter examines the legal conditions that have arguably contributed to the growth of oligopolistic market niches in the American economy. Not the least the relaxing of antitrust law is discussed as a long-term policy commitment, beginning during the Reagan presidency in the 1980s. The chapter reviews relevant legal theory literature and points at the debates and disputes regarding the value of antitrust legislation to preserve a dynamic and competitive economic system. The Chapter concludes that "anti-antitrust" scholars have been able to strongly shape law enforcement practices, with considerable consequences following.
