Between the eagle and the panda: ASEAN's perspectives on human rights

Abstract

ASEAN’s human rights perspectives evolved from an initial emphasis on non-interference and non-intervention to a willingness to address fundamental human rights. First recognised as a distinctive subject of ASEAN concern in 1993, the adoption of the ASEAN Charter in 2007 led to the establishment of the ASEAN Intergovernmental Commission on Human Rights (AICHR) in 2009 and the signing of the ASEAN Human Rights Declaration in 2012. The article discusses AICHR’s operational processes and assesses ASEAN’s commitment to international human rights conventions. A concluding section highlights the divergent approaches of Western states that focus on individual civil and political rights, and states like China that emphasise the economic, social and cultural rights of the community. ASEAN has adopted an approach that balances rights with responsibilities and obligations, and its position is still evolving.
