Nurturing the 1980 Hague Abduction Convention

Abstract

This final chapter examines the four key themes which a thematic analysis of the Handbook chapters revealed as important to consider in the years ahead: (i) the effects and consequences of international child abduction; (ii) the uneven playing field of the 1980 Hague Convention; (iii) the 1980 Hague Convention as an instrument to protect children must not become an instrument of harm to them; and (iv) nurturing the 1980 Hague Convention so it remains fit for purpose. There are important opportunities ahead to meet the challenge of future-proofing the Convention so it can successfully continue, in contemporary circumstances, to honour and fulfil its laudable aim of protecting children internationally from the harmful effects of abduction. In light of the Eighth Special Commission planned for October 2023, the preparation of an Information Document and the establishment of an interdisciplinary experts’ group / working group, within the mandate of the HCCH and Permanent Bureau, are suggested as initial steps in considering, developing and taking forward the themes and challenges identified in this Handbook.
