Abstract

In this chapter, we explain and challenge some fundamental propositions of the property rights theory by pinpointing some crucial theoretical, methodological and analytical weaknesses. We do so by addressing the question of the origin and evolution of property rights. Our investigation reveals the inability of new institutional economics to fully grasp the notion of property, providing instead a rather narrow and problematic definition of property rights. We also provide a broad critique of the methodological and analytical bedrocks of the theory of property rights and we interrogate the empirical validity of the theory in the case of land tenure in sub-Saharan Africa.
