New frontiers of PPP law

Abstract

The purpose of this chapter is partly to present the existing legal frontiers of PPPs and to discuss the future challenges and possibilities for PPPs in regard to the green transition. Today, PPPs are driven by the interests of increasing the quality and efficiency of public services in general, for solving infrastructure needs, cost-efficiency as well as developing growth and innovation as e.g., climate resilient infrastructure. This chapter presents different types of regulation for PPPs, the need for regulating PPPs in the future with the green transition in mind, and a climate perspective on new types of PPPs that have not been regulated yet. The chapter includes both a civil law and a common law perspective. Hence, this chapter covers matters concerning existing PPP legal frameworks and points to some new directions for PPPs as a tool for the climate change transition.
