Property law for the Circular Economy

Abstract

The Circular Economy following the servitisation model is also up and coming in the real estate sector. Nevertheless, classical property law contains various constraints for the full development of circular real estate. This contribution analyses how these constraints can be overcome by applying an innovative approach to the building lease (real right of superficies).
