Data ownership

Abstract

Data ownership is a contested topic in the European systems of private law. This contribution aims to provide a general overview of the current state of the debate on data ownership within the three major legal traditions in Europe: French law, German law, and English law. A comparative methodology is used to investigate the manner in which questions on data ownership surface within the different legal systems and how they are rooted in their respective systems of property law.
