The interplay between private and public international law regarding procedure

Abstract

This chapter addresses some of the interfaces between public and private international law at the procedural level. Relying on examples, it focuses first on adjudication from an institutional standpoint in order to show the porous nature of the boundary between national and international adjudication. Also referring to specific examples, it next turns to rules on procedure to check the impact of public international law constraints on private international law procedural solutions, and to explore the trend of international tribunals to adopt domestic and international commercial rules on procedure to fill the gaps in their own procedural frameworks.
