General principles of procedural law

Abstract

This chapter discusses the general principles of procedural law applicable before international courts and tribunals. It surveys instances in which inter-state dispute settlement, investor-state arbitration and regional human rights bodies have taken account of ‘general principles of law’ in the context of procedural matters. The chapter examines principles with broad implications for the judicial process (namely, good faith and the proper administration of justice), as well as more specific principles relating to jurisdiction and admissibility, the independence and impartiality of adjudicators and those relating to proving facts and law.
