Abstract

The need to delimit the area of interests protected by liability law arises in every legal system. Some civil codes (e.g. France) remain silent on this problem and leave the delimitation to courts and judge made law. Others (e.g. Germany) define a catalogue of rights and interests, which are protected by tort law. The first solution provides more flexibility, the second greater calculability.
