Die direkten Kosten der Anwendung des Betriebsverfassungsgesetzes: Ergebnisse einer Unternehmensbefragung aus den Jahren 2003/2004

Abstract

Die Bundesrepublik Deutschland ist im internationalen Vergleich das Land mit den meisten Mitbestimmungsgesetzen. Nirgendwo sonst sind die Mitwirkungs- und Mitbestimmungsrechte der Arbeitnehmer so weitgehend geregelt wie hier. Im Mittelpunkt dieser Gesetze steht das Betriebsverfassungsgesetz. Neben seinen Mitbestimmungsregelungen ist es aber auch ein Kostenfaktor für die Unternehmen. Die Anwendung dieses Gesetzes kostet 650,12 Euro pro Mitarbeiter und Jahr. Den Hauptanteil an diesen Kosten haben mit 337,95 Euro die Kosten der Betriebsratstätigkeit, gefolgt von den Kosten der jährlichen Betriebsversammlungen (146,69 Euro) und der Einigungsstellenverfahren mit 60,32 Euro. Die Untersuchung zeigt aber auch, dass durch eine partnerschaftliche und vertrauensvolle Zusammenarbeit von Betriebsrat und Arbeitgeber viele Kosten eingespart werden können.
