Abstract

El presente ensayo se ocupa del análisis económico del derecho. Para ello, lo estudia y utiliza sus conceptos, instrumentos y metodología; además, realiza un ejercicio para evaluar y contrarrestar situaciones especiales, como la informalidad y la superposición de modos de producción, así como para diferenciar entre costos de transacción y el costo de la función social del Estado. Este trabajo propone que el acceso al bienestar es la meta esencial de la organización social. Para ello, se requiere de niveles institucionales coherentes y debidamente estructurados que generen equilibrios en las relaciones sociales; equilibrios cuyas expresiones se pueden medir a través del uso de la libertad, del acceso a la justicia.
