El crimen como oficio. Ensayos sobre economía del crimen en Colombia

Abstract

La teoría económica del crimen parte del supuesto de que el criminal es un agente maximizador. Este fue el aporte del Premio Nobel de Economía GARY BECKER en su artículo “Crime and Punishment: an Economic Approach”, publicado en 1968. Según BECKER, los criminales tratan de maximizar sus ganancias y para ello hacen evaluaciones de riesgos, ingresos y costos. Dicha teoría es útil en la medida en que analiza la conducta criminal como una conducta racional. Desde luego, la teoría económica del crimen no sirve para analizar todos los delitos. Por ejemplo, dicha teoría no explica adecuadamente los crímenes pasionales y tiene muchos problemas para explicar el delito político. Los delitos que mejor se ajustan al análisis económico son aquellos en los que el ánimo de lucro tiene un papel preponderante. De ahí que sean los delitos que generan un flujo de ingresos los que mejor pueden ser entendidos a la luz de las herramientas del análisis económico.
