Abstract

El presente libro analiza las principales manifestaciones del pensamiento jurídico occidental sobre los derechos de la naturaleza, comenzando por los juicios civiles y penales contra los animales en la Edad Media, las leyes ecológicas del régimen nazi, las declaraciones internacionales y el constitucionalismo ambiental latinoamericano, hasta llegar a las ordenanzas municipales de Estados Unidos, la Constitución verde ecuatoriana y las recientes leyes de la Madre Tierra en Bolivia. Estas normas consagran a la naturaleza como un nuevo sujeto de derechos y crean amplios mecanismos para su protección, y el alcance y desafíos de este nuevo paradigma jurídico son estudiados a la luz del pensamiento político verde, planteando nuevos escenarios de debate sobre un tema cada vez más relevante a nivel internacional.
