Abstract

El objeto del presente estudio es la descripción y análisis del origen, constitución, estructura, contenido y efectos de la servidumbre petrolera, así como entender la manera como opera la indemnización previa de perjuicios causados por su ejercicio. Con este propósito, este libro no solo aborda la Ley 1274 de 2009, sino que se extiende a los principios del derecho civil y lo previsto en el respectivo código. Así las cosas, en el primer capítulo se identifica el lugar que ocupa la servidumbre petrolera entre los derechos superficiarios y del subsuelo. En el segundo capítulo se aborda lo referente al contenido de la servidumbre petrolera y el modo para buscar la reparación de los perjuicios ocasionados por ésta. Por último, en el capítulo tercero, se analiza la forma de adquirir el derecho de servidumbre petrolera y los mecanismos mediante los cuales se concreta el deber de indemnizar.
