Abstract

Esta investigación llena el vacío, hasta el momento existente en la literatura, de un análisis dogmático y crítico de los dos principales modelos de regulación de los servicios públicos, el de monopolio estatal y el de libertad económica, y de la síntesis de tipo fichteano (la libertad con intervención) que nuestros ordenamientos jurídicos han intentado durante las últimas décadas. Solo un estudio como este, en perspectiva histórica y dialéctica, permite comprender las tensiones esquizofrénicas en las que se debate la regulación de los servicios públicos en el siglo presente.
