Acerca de la antijuridicidad de los disparos mortales en el muro

Abstract

Kai Ambos realiza un estudio sobre el problema jurídico de los disparos mortales realizados en el Muro de Berlín antes de la Unificación de Alemania. Con tal fin analiza la decisión de 1997 de la Corte Constitucional Federal de Alemania a través de una presentación sistemática de la misma para apreciarla críticamente y diferenciar entre la antijuridicidad del comportamiento del autor inmediato (soldado de frontera) y los autores mediatos (generales y miembros del Consejo Nacional de Defensa).
