Abstract

El texto que presentamos a consideración de la Academia Colombiana contiene las ponencias debatidas en el seminario “La ponderación en el Derecho”, organizado por el Centro de Investigación en Filosofía y Derecho de la Universidad Externado de Colombia durante los días 6 y 7 de julio de 2006. El evento contó con la participación de destacados expertos en el tema de la ponderación, como Matthias Jestaedt (Alemania), Rodolfo Arango Rivadeneira, Carlos Bernal Pulido, Manuel José Cepeda Espinosa, Oscar Julián Guerrero Peralta, Alexei Julio Estrada, Henrik López Sterup, Ana María Montoya Caballero, Néstor Osuna Patiño y Jaime Orlando Santofimio Gamboa (Colombia). Durante el seminario se expusieron posiciones críticas con respecto a esta importante herramienta de interpretación constitucional y su aplicación práctica en ámbitos específicos del derecho.
